terms of service
What we agreed to, in writing.
These are the terms of working with Gauge. Written to be read, not to hide anything: if something isn't clear, write to us before approving.
1. Who we are
Gauge is a web design and development studio with an office at Av. Providencia 1208, Santiago, Chile. Contact: hola@gauge.cl. By approving a proposal and paying, you accept these terms.
2. How the service works
- You tell us about your business. Through the form, by voice message or on WhatsApp. No cost, no commitment.
- We show you a proposal. Within 2–4 business days you get a link to your designed page — with your name, your copy and the plan we recommend — to review. Still no cost.
- We adjust it with you. You comment on the proposal and we fix it. Once you're happy, you approve it.
- You pay. On approval, you pay the plan's starting price via Flow (cards, Webpay, transfer). Gauge never sees or stores your card details.
- We publish it. Within 48 hours of payment confirmation, your page goes live on your domain.
The proposal you approve is the contract: what it shows is what gets delivered. Anything not in it is requested as an adjustment (point 6) or quoted separately.
3. Prices and payment
- Presentación ($ 69,900 + $ 9,900/month), Catálogo ($ 119,900 + $ 19,900/month) and La llave ($ 249,000, one-time) prices are fixed, in Chilean pesos and include VAT. A tu medida projects are quoted in UF, with their own proposal and timeline.
- The price on your proposal is the price you pay. If we change published prices, your active proposal doesn't change.
- We issue a receipt or electronic invoice for every payment. For an invoice we need your RUT, legal name, business activity and address before charging.
- The monthly fee is charged from the second month, counted from launch, and covers: the page staying online, chat support, and the adjustments included in your plan.
4. Timelines
- Proposal: 2–4 business days from when we receive what you tell us. If we need more, we ask on day one.
- Launch: 48 hours from payment confirmation. A commitment, not an estimate.
- The launch timeline only pauses for something that depends on you: an existing domain that needs transferring, missing content, or an access we haven't received. We notify you the same day and the clock resumes once we get it.
5. What's yours and from when
| Plan | Presentación and Catálogo | La llave | A tu medida |
|---|---|---|---|
| Domain | In your name from registration | In your name from registration | In your name from registration |
| Third-party accounts (bookings, payments, Google, analytics) | With your email, from creation | With your email, from creation | With your email, from creation |
| Copy, photos and brand | Always yours | Always yours | Always yours |
| Code and hosting access | Yours once you complete six months of the monthly fee. If you leave sooner, you pay the remaining monthly installments up to six months and keep the code. | Yours from day one, delivered at launch | Per the proposal |
Gauge retains the right to use the proprietary components and tools it builds every page with, and to show your page as completed work, unless you ask us in writing not to.
6. Adjustments and support
- An adjustment is a bounded change to the published page: a text, a photo, a schedule, a price, reordering a section. Presentación includes 1 per month; Catálogo, up to 4. Adjustments don't roll over between months.
- A new section, a redesign or a new integration aren't adjustments: they're quoted before being done.
- Chat support with a 48-hour response (Presentación) or same business day (Catálogo). La llave doesn't include support or maintenance; those can be contracted separately.
- We only support pages we built.
7. Monthly fee, commitment and cancellation
- No minimum commitment. You can cancel whenever you want, by writing to us on chat or by email.
- When you cancel, your page stays live until the end of the month you already paid for. It's then taken down, and the domain remains yours to point wherever you like.
- If you've already completed six months when you cancel, we hand over the code and access at no cost. If not, point 5 applies.
- If a monthly payment isn't made, we notify you and give 15 days; after that the page is unpublished until it's settled. We don't charge interest or penalties.
8. Domain
We register the domain in your name (or your company's) with NIC Chile or the relevant registrar. The first year is included in the starting price. Annual renewal is your responsibility — around $ 10,000 for a .cl — and we notify you at least 30 days before it expires. If you already have a domain, we use it; we only need access to point it.
9. Integrations and third-party services
Bookings, payments, maps, WhatsApp and analytics run on external providers (Calendly, Cal.com, Flow, Mercado Pago, Google, Meta, Umami, among others). We connect them and keep them working; their terms, prices and availability belong to each provider and can change. Before starting, we tell you what can and can't be connected, and mark it in your proposal.
10. Your content
You're responsible for having the right to use the text, photos, logos and trademarks you give us, and for your page's content complying with the law. If you ask us to publish something we know infringes third-party rights, we'll say so and won't do it.
11. Warranty
Every published page has a 30-day warranty from launch: if something doesn't work or isn't what you approved, we fix it at no cost. What's covered, what isn't, and how to claim it is at gauge.cl/en/garantia, which is part of these terms.
12. Liability
We're responsible for the page working and matching what you approved. We're not responsible for business results, third-party provider outages, or content you gave us. In any case, our total liability is limited to what you paid us in the last twelve months, except where the law doesn't allow limiting it.
13. Personal data
How we handle what you tell us is in the privacy policy, which is also part of these terms.
14. Changes and applicable law
We may update these terms; the current version is always on this page with its date, and we'll email you if a change affects you. They're governed by Chilean law, including Law 19.496 on consumer protection. Any dispute we first try to resolve by talking; failing that, it falls to the courts of Santiago, Chile.
If any of this makes you unsure, write to us before approving. It's better to sort it out there.
